Employment Law Legislative Update

Certain employment legislation is usually updated annually to take account of inflation. The following legislation has been introduced for this purpose:

The Employment Rights (Increase of Limits) Order (Northern Ireland) 2020

The Order increases, from 6 April 2020, limits applicable to certain awards and payments under employment rights legislation in Northern Ireland in line with the Retail Prices Index, for example:

  • Limit on amount of guarantee payment payable to an employee in respect of any day increases from £29 to £30
  • Limit on amount of compensatory award for unfair dismissal increases from £86,614 to £88,693
  • Maximum amount of “a week’s pay” for the purpose of calculating a redundancy payment or for various awards including the basic award of compensation for unfair dismissal increases from £547 to £560

The Social Security Benefits Up-rating Order (Northern Ireland) 2020 & The Social Security Benefits Up-rating Regulations (Northern Ireland) 2020

The Order & Regulations make provision for the updating of rates of certain social security benefits, pensions and allowances from April 2020 in Northern Ireland. They alter the rates and amounts of certain social security benefits and other sums, such as statutory sick pay, statutory maternity pay, statutory paternity pay, statutory adoption pay and statutory shared parental pay and more, mainly from 6th April, for example:

  • SSP increases from £94.25 to £95.85
  • The normal weekly rate of statutory maternity pay, statutory paternity pay, statutory adoption pay and statutory shared parental pay increases from £148.68 to £151.20
